Dear Appellate Section Members:

There are four matters of interest to appellate practitioners that we wanted to bring to your attention: (1) the Nominations Committee seeks input for future section council positions; (2) entries are being accepted for the Appellate Haiku Contest; (3) the 20th Annual Advanced Civil Appellate Practice Course will be held at the Four Seasons in Austin on September 7-8, 2006; and (4) the Section annual meeting will be held on September 7.

  1. Nominations Committee Seeks Input
    The Nominations Committee requests input from section members for future council positions: (1) three council members, serving three-year terms, and (2) Secretary, serving a one-year term. In offering suggestions, please briefly explain, in two or three sentences, the recommended member's interest and qualifications for serving on the council. Please provide this information to the Chair of the Nominations Committee, Pam Baron, at 512-479-8480 or psbaron@austin.rr.com  by August 21, 2006.

    Note: In the position of Secretary, the committee will give preference to members who have previously served on the section's council. In council positions, the committee will consider factors including whether the member has been substantially involved in section matters and committee work. If you are interested in serving on a committee or becoming more involved in the section, please contact Randy Roach at rroach@cookroach.com.

  2. Haiku Contest
    The section is pleased to announce its second Appellate Haiku Contest. Prizes will include gift certificates for Texas Bar CLE programs, appellate books, and CLE materials. All entries must be received by August 31, 2006. Visit the section website at www.tex-app.org for more information, including contest rules.

  3. Advanced Civil Appellate Practice Course
    The 20th Annual Advanced Civil Appellate Practice Course co-sponsored by Texas Bar CLE and the Appellate Section will be held at the Four Seasons in Austin on September 7-8, 2006, along with an Appellate Boot Camp on September 6. Section members receive a $25 discount.

    The section will make available a limited number of need-based scholarships for the Appellate Book Camp and the Advanced Civil Appellate Practice Course. The scholarships will reduce tuition for the Book Camp to $50 and tuition for the Advanced Course to $100, although applicants with significant financial need may request a full scholarship.   4. Annual Appellate Section Meeting and Reception
    The Section annual meeting will be held on Thursday, September 7, at the Advanced Course at the Four Seasons in Austin at 5 p.m. There will be a short business meeting, and we will also announce the winners of the Appellate Haiku Contest. There will be a reception with the judiciary immediately following the annual meeting.

Dear Appellate Section Members:

There are four matters of interest to appellate practitioners that we wanted to bring to your attention: (1) applications for new Editor of the Appellate Advocate being accepted; (2) Appellate Advocate seeks articles; (3) Advanced Civil Appellate Practice Course; and (4) assistance with Insurance Section's Brief Bank Project.

  1. Applications for New Editor of the Appellate Advocate being accepted.

    Applications are being accepted for the position of Editor of the Appellate Advocate, the Appellate Section's newsletter. The application should include a resume and an explanation of qualifications for the position. The one-year term will begin September 2006. Applications must be received by Robert M. "Randy" Roach, Jr. at rroach@cookroach.com or Cook & Roach, L.L.P., 1111 Bagby Street, Suite 2650, Houston, Texas 77002, by 5:00 p.m. on May 1, 2006.


  2. Appellate Advocate seeks articles.

    The Appellate Section newsletter, the Appellate Advocate, is seeking articles. The next submission deadline is June 13, 2006. Please send all submissions to Kimberly R. Phillips at kphillips@gardere.com or Gardere Wynne Sewell LLP, 1000 Louisiana, Suite 3400, Houston, Texas 77002-5011.


  3. Advanced Civil Appellate Practice Course.

    Each year an Advanced Civil Appellate Practice Course is co-sponsored by the State Bar of Texas CLE and the Appellate Section. This year's course will be held at the Four Seasons in Austin on September 7-8, 2006, along with an Appellate Boot Camp on September 6.

    The Appellate Section will make available a limited number of need-based scholarships for the Appellate Book Camp and the Advanced Civil Appellate Practice Course. The scholarships will reduce tuition for the Book Camp to $50 and tuition for the Advanced Course to $100, although applicants with significant financial need may request a full scholarship. Further details can be found on the section website.

    The University of Texas School of Law sponsors an annual Conference on State and Federal Appeals. It will be held on June 1-2, 2006 in Austin. Information on the conference can be obtained from the UT Law CLE website.

  4. Assistance with Insurance Section's Brief Bank Project.

    The Insurance Law Section is working to create a brief bank for the Section's website. The goal is to post a copy of the briefing in cases of substantial importance that are currently in the judicial pipeline. If successful, then the entire membership will be able to view the latest developments in Texas insurance law. The second part of this project is to prepare a "greatest hits" section that includes key cases from past years. For those that have kept copies of briefing in important cases, receiving these would be appreciated as well. The Appellate Section membership would also have access to this information.

    Again, this project cannot reach its full potential without contributions from the individual members. If you have briefs, either from current or past cases, that you would like to contribute, please forward them to: Vincent E. Dear Appellate Section Members:

There are two matters of interest to appellate practitioners that we wanted to bring to your attention: (1) Appellate Section contribution for having treatise scanned and made available on-line; and (2) request for volunteers for disaster relief effort.
  1. Contribution for scanning treatise.

    The Friends of the State Law Library is working with the library to have scanned and posted the two-volume treatise: George D. Braden, THE CONSTITUTION OF THE STATE OF TEXAS: AN ANNOTATED AND COMPARATIVE ANALYSIS 272 (1977). The book is out of print and is a key resource in any case involving the Texas Constitution. The Appellate Section has supported this project by donating the cost of the scanning. The scanned treatise will be made available on-line through the State Law Library.


  2. Disaster relief effort. Pro bono volunteers are needed to help with disaster relief. Attorneys and paralegals can join the Disaster Relief Practice Area on-line to volunteer to help represent clients who have legal problems related to Hurricanes Katrina and Rita.

Dear Appellate Section Members:

There are four matters of interest to appellate practitioners that we wanted to bring to your attention: (1) Appellate Limerick contest announcement and rules; (2) upcoming CLE and scholarship opportunities; (3) Appellate Section annual meeting; and (4) new postings on the Appellate Section website.
  1. Calling all appellate poets! Again!
    From the people who brought you last year’s wildly successful appellate haiku contest, the Appellate Section continues its exploration of poetic traditions by offering the 2005 Appellate Limerick Contest. A limerick consists of five lines, in which lines 1, 2, and 5 rhyme with each other and have three rhythmic feet, and lines 3 and 4 rhyme with each other, and have two rhythmic feet. For example:
    There once was a brief I had written
    That I was sure – from where I was sittin’ –
    Would have torn asunder
    The lower court’s blunder.
    But the higher court just wasn’t list’nin’.

    Facing a jury charge waiver
    Is not a position to savor.
    A plea for new trial
    Will end in denial.
    They likely won’t grant you the favor.

    Contest prizes will include free tuition to State Bar of Texas CLE courses and famous and useful appellate treatises and CLE materials. But let’s not kid ourselves: the real motivation here is the chance to have your name announced and your limerick read to the thousands in attendance at the Appellate Section Annual Meeting, not to mention being published and read by millions on the Section website and in The Appellate Advocate. If the respect of your peers means anything to you, it’s hard to imagine gaining more respect than being the winning appellate limericist.

    Appellate Limerick Contest Rules:
    • All entries must relate in some loose fashion to appellate law.
    • All entries must comply with the definitional requirements of a limerick described above.
    • All entries must be received by 3:00 p.m. on August 31, 2005, by e-mail to limrix@adjtlaw.com, or by snail mail or hand delivery to Kevin Dubose, Alexander Dubose Jones & Townsend LLP, 1844 Harvard, Houston, Texas, 77008.
    • By submitting an entry, contestants: (a) certify that the submitted work is original, and (b) grant a non-exclusive license to the Appellate Section to read, use and publish entries in any form of oral, print, or internet medium.
    • Any entrant who is not a dues-paid member of the Appellate Section on September 1, 2005 is ineligible to win prizes. Any Appellate Section officer or member of the Appellate Limerick Contest Judging Panel is ineligible to win prizes. Persons who are ineligible to win prizes may still submit entries, which may be read at the awards ceremony and printed thereafter.
    • Although limericks are often “bawdy,” “ribald,” or “obscene,” no awards will be given to entries that are so offensive that the judges cannot bring themselves to read the entry in public or publish it in otherwise respectable publications and websites.
    • Contestants are limited to no more than three entries per contestant.
    • The choice and number of prizes will be within the unfettered discretion of the judges. Decision of the judges is final and unappealable. Need not be present to win. Offer void where prohibited by law.


  2. Advanced Civil Appellate Practice Course and Appellate Boot Camp.
    Three days of appellate CLE are less than a month away! The Appellate Boot Camp, a one-day course featuring basic appellate topics, will be held on September 7 at the Four Seasons in Austin. The Advanced Civil Appellate Practice Course, two days of advanced appellate topics, is scheduled for September 8-9, also at the Four Seasons in Austin. The course brochure is available on-line at http://www.texasbarcle.com/CLE/HOME.ASP through the “Upcoming Seminars” link.

    Section members receive a tuition discount. There is also a discount for early registration for the Advanced Course; the deadline is August 24.

    The Appellate Section awards need-based scholarships for the Boot Camp and Advanced Appellate Course. Information on scholarships is available at http://www.tex-app.org/cle.html.

  3. Annual Appellate Section Meeting and Reception.
    The Section annual meeting will be held on Thursday, September 8, at the Advanced Course at the Four Seasons in Austin at 5 p.m. There will be a short business meeting, followed by a presentation honoring the memory of Helen Cassidy. We will also announce the winners of the Appellate Limerick Contest. There will be a reception with the judiciary immediately following the annual meeting.

  4. New information available on the Appellate Section website.
    The Appellate Section Website now has available, in downloadable and word-searchable pdf format, most of the articles presented at the following 2004 CLE courses: UT's Conference on State and Federal Appeals, the State Bar's Advanced Civil Appellate Practice Course, the State Bar's Appellate Boot Camp, and the State Bar's Practice Before the Supreme Court. We want to thank all the authors for giving us permission to make those articles available. There are five matters of interest to appellate practitioners that we wanted to bring to your attention: (1) recent changes to the Texas Supreme Court website; (2) request for articles for The Appellate Advocate; (3) upcoming appellate CLE opportunities; (4) Appellate Section website news; and (5) on beyond haiku.

1. Texas Supreme Court posts oral arguments to website, expands e-briefing.

Supreme Court Posts Recorded Arguments:

On December 3, 2004, the Texas Supreme Court website began posting links to audio recordings of oral arguments in MP3 format. Future arguments should be accessible by the end of the day of argument, while previously recorded arguments will be added in stages. Visit http://www.supreme.courts.state.tx.us/oralarguments/audio.asp to view the available recordings.

Supreme Court To Expand E-briefing:

On December 17, 2004, the Texas Supreme Court began requesting electronic copies of briefs in all cases in which the Court requests full briefing on the merits. In these cases, the Court will ask the parties to submit electronic versions of petition-stage and merits-stage briefing. The Court also will request electronic copies of amicus briefs. In the past, the court has asked for e-briefs only in cases granted and set for argument. Visit http://www.supreme.courts.state.tx.us/ebriefs/ to view the Supreme Court's collection of e-briefs.

2. Call for articles for The Appellate Advocate.

3. Upcoming appellate CLE opportunities.

April 1: State Bar of Texas, Practice Before the Texas Supreme Court, Joe C. Thompson Conference Center, Austin. A full day devoted solely to Texas Supreme Court topics. Discount available for those also attending September Advanced Appellate Course.

June 1-3: University of Texas, 15th Annual Conference on State and Federal Appeals, Four Seasons, Austin. Course features an evening writing seminar with Professor Timothy Terrell, Emory University School of Law, on Wednesday, June 1, followed by two days of state and federal appellate topics.

September 7: State Bar of Texas, Civil Appellate Boot Camp, Four Seasons, Austin. A one-day course featuring basic appellate topics.

There are three matters of interest to appellate practitioners that we wanted to bring to your attention.

1. ABA Summit of Appellate Lawyers and Judges November 12-14 in Dallas.

The ABA Council of Appellate Lawyers (CAL) will be holding its principal educational seminar this year in Dallas, Texas from November 12-14 in conjunction with the kick-off of the Appellate Judges Education Institute. This seminar provides a unique opportunity to learn from and engage in discussion with appellate judges from throughout the United States. A significant number of appellate judges will be participating on panels and in the audience. You can learn more about the program and register at the CAL website: http://www.abanet.org/jd/ajc/cal/. 2. State Bar Referendum on Referral Fees: On-Line Voting Begins November 5.

On October 1, the Supreme Court of Texas ordered a referendum of all Texas lawyers on modifications to the Texas Disciplinary Rules of Professional Conduct (Disciplinary Rules) concerning referral fees and advertising. For more information, visit www.texasbar.com. Online electronic voting will begin Friday, November 5 and end at midnight on Sunday, November 14. Lawyers who do not vote online will be mailed paper ballots on Saturday, November 20. Paper ballots must be received by the State Bar at the Texas Law Center by 5:00 p.m. on Monday, December 20 to be counted.

3. New information available on the Appellate Section website; Fourth Court of Appeals adopts new internal operating procedures.

Please check the Appellate Section website www.tex-app.org on a regular basis for new postings. Recent additions include the winning entries in the Appellate Haiku contest and photos from the annual meeting and Advanced Course held in September 2004 (see article on the home page and click on the links). We are also in the process of posting the new internal operating procedures adopted earlier this month by the Fourth Court of Appeals in San Antonio and hope to have those available on the website within the next week.

We are proud to announce that after diligent work by our outstanding Website Committee, chaired by Marcy Greer and Clint Sare, we have a new look to our website with new features--launched today!

First, the website contains more information in more user-friendly format. Second, we have new features, including a Google search engine for the site, all of the Appellate Advocate editions, additional subject/author indices, an updated membership directory, and dozens of CLE papers. Calling all appellate poets!

The Appellate Section is pleased to announce its first (and maybe last) appellate haiku contest. A haiku is a Japanese poem with rigid structure requirements: the poem must be three lines, containing five, seven, and five syllables, respectively. Here are a few examples:

Writ of mandamus
Emergency stay needed
Don't file on Friday.

No brief is as good
as the one we dream about
after it's over.

First prize will be a gift certificate for tuition for the 2005 Appellate Boot Camp and the Advanced Appellate Course. Second and third place winners will each receive a gift certificate for tuition for one State Bar CLE program. Additional prizes (like useful appellate books and CLE materials) may be awarded in the discretion of the judges.

All entries should relate to appellate law in some way and be submitted no later than September 1, 2004 by e-mail to ebloch@mailbmc.com or by snail mail to Heidi Bloch, Brown McCarroll, 98 San Jacinto Blvd., Suite 1300, Austin, Texas 78701 (note: the mailbox rule does not apply). Winners will be announced with much hoopla at the Section annual meeting on September 9, 2004 in Austin but winners need not be present to win.

Small Print: By submitting an entry, participants certify that the submitted work is original and further grant the Section a non-exclusive license to the use and publication of their poems at the Section's annual meeting, on the Section website, in the Appellate Advocate, in Section promotional materials, and in any Richard Linklater or Michael Moore film based on the contest. Only entrants who are Section members on September 9, 2004 are eligible to win. Officers and council members of the Section are not eligible to win but may submit entries for publication and glory. The Section is not responsible for entries lost in cyberspace. Judges have absolute discretion to determine the winning entries and their decisions will be final and not reviewable in any way, shape, or form, like convenience venue transfers. See Garza v. Garcia, 47 Tex. Sup. Ct. J. 570 (May 14, 2004). Winning entries will be posted on the website and/or published in the Appellate Advocate sometime af! ter the Section's Annual Meeting.

Dear Appellate Section Members:

The Appellate Section Council voted to notify you of the following information regarding a newly scheduled legislative hearing on potential Appellate Court Redistricting:

The Texas House of Representatives is hearing public testimony on Appellate Court Redistricting. One hearing was held on April 27, at which several Chief Justices of the various Texas Appellate Courts testified. You may review that testimony at http://www.house.state.tx.us/media/weekly.php.

Some additional Chief Justices will be testifying on Wednesday, June 16, at 9 a.m.

As I advised you previously, Suzanna Chapman, the Clerk for the House Committee on Redistricting who works in Texas Representative Joe Crabb's office, stated that there is no plan or bill for or against which any of the persons testifying will be speaking. The Committee seeks information about how things are now, including benefits and problems of the current system. The Committee also seeks information on whether the status quo should remain.

She said there are three "interim charges" facing the Committee: (1) Appellate Courts; (2) Lower Courts; and (3) District and County Attorneys. She gave me the following link to the "interim charges": http://www.house.state.tx.us/committees/charges/78interim/03nov4.pdf

The Committee is seeking information on those charges from people with various experiences, including the Appellate Court Chief Justices, the Court of Criminal Appeals, presiding judges of the administrative judicial districts, and the District and County Attorneys. She said she also has asked State Bar of Texas President Betsy Whitaker to testify on behalf of the State Bar.

For those who are interested in attending these public hearings, the June 16 hearing will begin at 9 a.m. The public hearing will be held at the Capitol on the 2nd basement level in Room E2.012.

If you plan to testify at these hearings, you must contact Suzanna Chapman at 512-463-9948 or at 512-463-0520. Those who testify at the hearing are expected to send written testimony to Suzanna by Tuesday, June 15. She also stated that you could bring the testimony with you to the hearing, but it is better to send the testimony and the copies to her before hand so she can distribute them to the committee members. She needs 20 copies.

As I advised you previously, Suzanna Chapman, the Clerk for the House Committee on Redistricting who works in Texas Representative Joe Crabb's office, stated that there is no plan or bill for or against which any of the persons testifying will be speaking. The Committee seeks information about how things are now, including benefits and problems of the current system. The Committee also seeks information on whether the status quo should remain.

She said there are three "interim charges" facing the Committee: (1) Appellate Courts; (2) Lower Courts; and (3) District and County Attorneys. She gave me the following link to the "interim charges": http://www.house.state.tx.us/committees/charges/78interim/03nov4.pdf.

The Committee is seeking information on those charges from people with various experiences, including the Appellate Court Chief Justices, the Court of Criminal Appeals, presiding judges of the administrative judicial districts, and the District and County Attorneys. She said she also has asked State Bar of Texas President Betsy Whitaker to testify on behalf of the State Bar.

For those who are interested in attending these public hearings, the June 16 hearing will begin at 9 a.m. The public hearing will be held at the Capitol on the 2nd basement level in Room E2.012.

If you plan to testify at these hearings, you must contact Suzanna Chapman at 512-463-9948 or at 512-463-0520. Those who testify at the hearing are expected to send written testimony to Suzanna by Tuesday, June 15. She also stated that you could bring the testimony with you to the hearing, but it is better to send the testimony and the copies to her before hand so she can distribute them to the committee members. She needs 20 copies.

Dear Appellate Section members:

As we approach our "seminar season" and the upcoming board certification exam in civil appellate law, we are in search of information that will benefit all of our members and encourage you to assist us.

Everyone talks about hyper-technical interpretations of the Texas Rules of Appellate Procedure, but no one does anything about them. Now is your chance, and at the same time, earn the chance to win a free rules book.

At the University of Texas School of Law Appellate Course in Austin, Texas, on June 3-4, a paper will be presented highlighting appellate traps. Appellate traps are interpretations of the Texas or Federal Rules of Appellate Procedure, or Texas or Federal Rules of Civil Procedure that result in trial court cases or appeals being decided based upon procedural "gotchas" rather than on the merits.

Help your fellow lawyers to become aware of these traps. If you know of a trap, please send a brief description of it, including the legal cite to the case in question, to scottr35@aol.com. The top twenty or so traps will be incorporated into the course materials. The first 50 people who send in a trap will receive a complimentary email copy of the course paper from the traps presentation. The top three traps will be awarded one soft-sided O'Connor's rules book of the winners' choice (maximum value including tax and shipping $100 each, to be purchased and shipped by Scott Rothenberg from his own funds). Deadline for receipt of your traps is noon on Friday, May 28, 2004. The winners will be selected by Scott Rothenberg, based upon his sole judgment.

The paper will be posted on the Appellate Section website, where all Appellate Section members can appreciate the benefits and results of the paper and other section members' participation.

One: Membership

Recently, you should have received your annual membership renewal form from the State Bar of Texas. As you complete the form, we invite you to renew your membership in the State Bar Appellate Section. Two: Potential Appellate Court Redistricting

The next hearing for the House Committee on Redistricting will be held on Monday, May 17th at 9:00 a.m. or upon adjournment of the House in room E2.036. The purpose of the hearing is to take invited and public testimony on the interim charges. Please refer to my email from last week for the maps and other materials.
